Accidents Caused by Texting and Driving

Texting on mobile devices while driving is dangerous, but you may not know exactly how dangerous it is.

The National Highway Traffic Safety Administration (NHTSA), states that over 3,300 people were killed and 387,000 injured in auto accidents caused by distracted drivers in 2011, prompting many states to ban texting while driving.  Texting is one of the chief distractions (if not now the most distracting) occurring in many cars currently.  Findings of the NHTSA indicate that texting while driving is equivalent to driving the length of a football field while blindfolded.

Virginia Tech Transportation Institute has found through their research that texting creates a crash risk 23 times higher than driving while not distracted.

Proving Negligence

Proving negligence in these cases will require an experienced auto accident and personal injury lawyer. The ideal situation is that there is a witness to the texting, but even if there is a witness, a subpoena for the defendant’s cell phone records may be necessary to secure a finding that the driver was texting when the accident was caused.  Proving that the driver was texting is not necessary to prove liability; the driver’s negligent actions are sufficient, however, a higher form of negligence may be provable when a driver engages in behavior like texting which shows their conscious indifference to the safety of others.

Your lawyer from The Law Offices of Adrian Crane may need to file a law suit to obtain a subpoena for the defendant’s cell phone records.  In other situations a defendant’s insurance company may produce the records without the filing of a lawsuit and the issuance of a subpoena.

In either event, your case will be stronger with the evidence, and getting this evidence is more likely to occur when you have an experienced and reputable law firm working in your best interests.
